Deborah Isser, senior rule of law adviser at the United States Institute of Peace, and Peter van der Auweraert senior legal adviser at the International Organisation for Migration have published a special report entitled ‘Land, Property, and the Challenge of Return for Iraq’s Displaced‘.
The report draws on the assistance offered by both USIP and IOM to the Government of Iraq’s efforts to design displacement-related land and property policies.
The Commission on the Resolution of Real Property Disputes provides recourse to victims of the Ba’ath regime through a quasi-judicial process, and the Council of Ministers’ Decree 262 and Prime Minister’s Order 101 facilitate property recovery through an interagency administrative process for those displaced in 2006 and 2007.
